I have been searching the web in an effort to determine what the new CDL regs (as of September, 2002)stipulate when a school bus driver is convicted of a DUI during his non-professional time behind the wheel. The website* below, from the state of Iowa, gave me part of the answer--if a driver is convicted of drunk-driving, even during his weekend off-time, in his own private vehicle, he will still forfeit his CDL license.
The question I have is -- if an ARD (accelerated return to driving?) program allows a convicted DUI driver to get his regular license back..say in four months -- would it follow that he would be allowed to return to commercial driving as well? Is a license a license, or does federal law supercede this ARD allowance? To be clear, I have no desire to have this driver return -- only that I would like to have the stance that a CDL driver cannot drive for a full year after such a conviction -regardless of what a state law or local judge allows.
