Our district is rural, but making the transition to suburban, like many areas of the country. Recently, a housing development has sprung up on a road that has not been dedicated to the township it is located in. Apparently, a resident has taken the developer to task about road drainage, and the township won't make it part of their system until it is resolved. My question is, what are the pitfalls in using a non-public road? Are there legal issues? The township is maintaining it, by the way-despite its status, because of all of the taxpayers living on it. Depending on where you are located in the country, there can be major issues related to the snow maintenance of private roads. This can be a serious safety issue.
My department in Michigan makes it a point to avoid the majority of private roads unless we are led down there by an IEP. As each new sub division arises (three this summer!!!) We judge each one individualy.

Private means private. Get permission or avoid those roads, regardless of the status of a student living on the road. The same with using parking lots and other private areas as turn-a-rounds, drop or loading areas. Get permission first. (jk)

My district's policy is that you don't go on private roads. (Of course, they require me to go down one, but, that's a political thing...)
