The other day one of are Drivers lost 3 Days of work with no pay. When supposely a parent called in and said that the Driver didn't cross her kid. The same Driver lost some days of work last year for something, I don't know What for. My point is we have another Driver that left a student (knd) on the bus for an 1 1/2 and went to lunch. The little boy weat his pants and was crying. The School had a law suit put on them I don't know if they won. Nothing happened to this driver, but a letter was put into her file. Two weeks later leaving School on a afternoon run, frist though third grade, she runs into the back of the bus in front of her, at a stop sign.She gets a letter put in her file.... I didn't think that was very fair.Were not union would union help or just a good attorney??????????????????

I agree 100% that it was not fair about the letter in her file. She should have been fired

Non-union employees don't always realize that what's right or morally right can be irrelevant to employer actions -- subjective is how some administrations define "right." An attorney is not much help, since regulators and the courts are somewhat hostile toward employees, defining employees as "Servants" and their employer as "Master." Under these circumstances the employer most often defines the employer/employee relationship and has the last word.
Some non-union employers provide a "Due Process" proceeding to determine the facts based on opposing opinions. The employer, often exclusively, decides the direction of the proceedings, fact finding (actually opinion finding), decides what the facts are and what action is to be taken.
The dysfunctional employer can turn Due Process into a kangaroo process. The parent says the bus driver did not cross the child; the bus driver says he did; the employer decides the so-called facts (what the employer believes happened) from these opposing opinions.
Unions, any worth their salt, bring balance to the relationship between the employees and their employer. Rather than a Servant/Master relationship, "Just Cause" and "Binding Arbitration" establish something similar to a partnership between employees and their employer. There are no guarantees the employee will be treated fairly. An unreasonable or bully-like employer may still issue unwarranted discipline or termination and regardless of the Just Cause findings.
An unwise acting employer, ignoring Just Cause findings, can find themselves brought into Binding Arbitration. The arbitrator, based more on evidence and precedence than on speculation or opinion, when finding in favor of the employee can require the employer to restore the employees records, any lost pay -- even require the employee rehired. If the employer ignores the arbitration order, and because of the contractual nature that Binding Arbitration imposes is recognized by the courts, my understanding is that a wronged union employee at that point can sue the employer.

I've often said that any career minded school bus driver should have a working relationship with a "personal injury" attorney experienced and competent in Workers Comp and contractual agreements. These days Workers Comp is in the sneaky business of denying valid claims. Nothing can replace an experienced attorney on your side in these matters, especially job related stress issues.
I've mentioned that there is little or probably nothing a non union school bus driver can do about a bully employer. What about a parent interfering with the employee/employer relationship, by making false statements about the employee to the point it jeopardizes the relationship? In this situation the bus driver might be able to sue the parent in civil court. My understanding is that the employee does not have to be fired. The employer moving the employee to another route, based on false accusations (especially if made in a public setting) is enough to claim interference with the relationship between the employee and his/her employer's contractual relationship. This might also be the case with letters of reprimand placed in the employee's file as a result of false accusations from a parent or parents.
I've been here too. It took four or so years to bring the case before a jury of twelve members. Although I can not personally disclose the settlement, I can say that the jury's decision made me very happy.
I do want to relate the reality that engaging in battle with an employer or suing parents can be much more stressful than simply seeking employment in some other rewarding occupation. Should the stress begin to affect your good health or disrupt your family it is probably time give serious thought to looking into another occupation.
For those that can take on the stress of battling for what's right for ones' good and the good of fellows might find some battles as rewarding as the job -- even more rewarding. (jk)

Thank you JK for your input. I have gone to the web pages That was on your letter, And well take note, I just remember when I was getting my license to drive bus my trainer that is my boss said, you have never work in a place like this before and wondering what she met by that. Comeing from haveing my own business and Rodeoing for many years and still do. I have never put employee's to were they hated there job, we were family also my many years of rodeoing being around people that you consider great friends. Maybe that's my problem I look for fairness in what we do and take responsability. And don't belive in playing with people's lively hood to make a living, just to help then out as much as they can help you out. Thanks agian JK

JEAN-CLAUDE THATS MY POINT WE HAVE A UNION TO REP. OUR DRIVERS AND MECHANICS. JUST BECAUSE A PARENT SAYS SOMETHING ABOUGHT A DRIVER IT DOSEN'T MAKE IT SO. I BELEAVE PRIVATE FLEETS CAN GET AWAY WITH MORE THAN A COUNTY RUN FLEET. OUR FLEET IS COUNTY RUN.

That is absolutely absurd that someone got 3 days with no pay and someone else got a slap on the wrist. There should be US Laws saying what punishment should be for school bus drivers!

Many times with certain drivers, it comes down to who they know. Favorites can get away if they know how to work the system like in any job arena. Or friends cover for friends. There is no rime nor reason to one union over non-union or small fleet over big fleet or municipal fleet over contractor. It all comes down to PEOPLE and you'll find one way or another all across America in any fleet.

My roommate has drove in a VERY large county owned shop for 23 years and she has a saying about this.....It is all who you know, beat and eat. I worked with her in that county for a very short time and when they hate you, they hate you. They will do anything, including call drivers and get them mad at you and then call you to get you mad at the other driver. They play games and the director sits on a fence.
Don't give up. Keep looking, that employer will do it to someone else and so on until they are found out.

BlueBird 6-8 Yes it's who you know you see i was raised in this town and related to everyone about. Broad member of the school i'm related too but they don't want to hear it they know what's going on, I don't talk to them about it anymore the only thing is i know why i'm still there, and that I'm not being picked on because of who i know. I have learn to go to my bus and go home after my route and keep to my self, if i get trips that's o.k. i don't ***** about it. I had my evaluation the over day and my boss, goes you got all 1's and my coment was i have learn something and he smiled and i said what, i go to my bus and go home and stay clear of the **** that goes on here.he didn't like it much. the other thing is they are training someone eles to become a boss and they think that she will be great I DON'T THINK SO she just like the one that we have now they are made of the same moled.and my question to everybody why do people play game's like this i don't understand this, this is a job where you have lives you take care of and not to meantion your own as to make a living maybe that will be a good topic. Well,we had a driver fired for cussing out a problematic kid. I don't really know much more than that.In your county/distric/company,what would running into the end of a guard rail get you. Silas J. 97-12 It will outrun your bus
